Present: Cllr A Vickers, Cllr R Brown, Cllr M Shaftesley (Chair), Cllr L Hunt, Cllr J Harrington, Cllr D Porter, Cllr C Carlin and Cllr T Postlethwaite

1/21 Election of Chair
Chair: Cllr R Brown was proposed by Cllr Hunt and seconded by Cllr Postlethwaite.
There being no other nominations Cllr Brown was duly elected and took the Chair.
Vice Chair: Cllr M Shaftesley was proposed by Cllr Hunt and seconded by Cllr Porter.
There being no other nominations Cllr Shaftesley was duly elected.

2/21 The Councillors agreed to their acceptance of office which will be signed on 7 May 2021 to comply with current Covid-19 restrictions.

3/21 Apologies for absence
Apologies were received from Cllr I Kirkby (holiday).

4/21 Minutes of the Annual General Meeting held in 14 May 2019
Minutes of the meeting held on 14 May 2019 were approved.
Proposed by Cllr Vicars and Seconded by Cllr Hunt.

5/21 Appointment of Councillors to Serve on Outside Bodies
Cllr Carlin to attend 3 tier and Mid Copeland meetings.
The representatives for School Governors and Village Hall Committee to be determined at the next Meeting.

There being no other business the meeting closed at 19.37.

6/21 Apologies
Cllrs Kirkby.

7/21 Exclusion of Press and Public
There were no items on the Agenda requiring the exclusion of press and public.

8/21 Declarations of Interest
There were no Declarations of Interest.

9/21 To Approve the Minutes of the meeting held on 13 April 2021
Cllr Shaftesley asked that the following omission be added to Minute no 133/20,1:
Planning application no 7/2021/4036 Concerns were expressed that the proposed development could easily be developed into a house.
Cllr Carlin asked that the following addition be added to Minute no 130/20 Telephone Box: A member of the public had raised the issue of adopting phone boxes within the Parish. After discussion it was resolved to discuss adoption when notification was received of a phone box being obsolete.
Subject to these amendments the minutes of 13 April 2021 were approved.

10/21 Police Liaison Report
A report had been previously circulated by the Clerk.

11/21 Progress Reports

11/21.1 Hard Knott Telephone Box
A member of the public had expressed concerns regarding the condition of the box and had been assured by the Clerk that this was being investigated and actioned.
It was resolved that estimates be obtained for the cost of refurbishing the telephone box. Details to be placed on the Eskdale Facebook page looking for local expertise to undertake repairs.

11/21.2 Defibrillator
It was resolved to obtain costs for the defib and the restoration of the Telephone Box and then seek funding from Eskfest and Eskdale Open towards the costs.

12/21 Public Participation
None.

13/21 County Councillor/District Councillor reports
None.

14/21 Applications for Development

14/21.1 To examine applications for development and submit observations to the Planning Authority
7/2021/4045 Fell View Garage, Eskdale
Demolition of commercial garage (Class E) and erection of dwelling house following withdrawal of application 7/2020/4094
It was noted that the only changes to the previous application was the inclusion of a Flood Risk Assessment. The Council resolved that the response to the previous application still applied and should be re-submitted as were agreed at the meeting of 10 December 2020.

14/21.2 To ratify the observations submitted by the Clerk under devolved powers since last meeting.
None undertaken.

14/21.3 To note the decisions of the statutory planning authority with regards to recent applications
7/2021/4029 1 Rigg Cottages, Eskdale
Erect detached double garage within garden curtilage
Approved with Conditions.

15/21 The Chair proposed that Agenda item 11.5 Eskfest be brought forward so that Mr T Smith was able to give an update.
Mr Smith stated that subject to Government guidelines and restrictions that were in place at the time, the Eskfest would go ahead 1-3 July 2021. Plans were to have a limited impact on the valley. A maximum of 1500 people will attend the event over the weekend. 25% of ticket sales would be donated towards community projects and the festival were keen to contribute towards a defibrillator.
The Chair thanked Mr Smith for his update.

16/21 Financial Records

16/21.1 To approve the following payments:
BHIB insurance renewal £271.85
V Falconer Internal Audit £40.00
CALC Annual Subscription £124.03
Proposed by Cllr Hunt Seconded by Carlin.

16/21.2 To note the receipt of payments
Precept £8000.00.

16/21.3 To receive and note the bank reconciliation statements dated 31.3.21
This had been reconciled by the Internal Auditor as part of the audit of the Council’s finances for 2020/21.

16/21.4 To consider the Budget Comparison Report as at 30 April 2021 and determine action need to address deviations from the budget
None required.

16/21.5 To receive and note the accounts for the year ending 31 March 2021 have been submitted and approved by the internal auditor and that they are a true and correct record.
Proposed by Cllr Carlin, Seconded by Cllr Harrington.

16/21.6 To determine that the Parish Council has met the qualifying criteria to certify them as exempt from a limited assurance review.
Cllr Shaftesley gave a brief outline of the previous problems that the Council had encountered with a past Clerk.
It was resolved that the Council met all the qualifying criteria to certify as exempt from a limited assurance review.

16/21.7 To determine a S137 Donation to the Parish Magazine
It was proposed by Cllr Carlin and Seconded by Cllr Hunt that a donation of £50 be made towards the cost of the production of the Parish Magazine.

17/21 Parish Matters

17/21.1 Housing Survey/Community Plan
A survey to be included in the next Parish Magazine, notices to be put up on Notice Board and advertised on the Eskdale Community Facebook page and the Website/

17/21.2 Meeting with United Utilities
A meeting has been arranged for 11 May 2021 to discuss issues.

17/21.3 Eskdale Open
It was resolved that they be approached for a donation towards the cost of refurbishing the phone box once quotations for works had been received.

17/21.4 EV Charge Points
Charge My Street had undertaken a survey of the car park and noted that there was only a single phase supply and the EV charge points required a 3 phase supply. The car park at Dalegarth was suggested as an alternative location.

17/21.5 Rural Broadband Consultation
Cllr Carlin to put up on Eskdale Community Facebook page asking for feedback from the community.

18/21 To receive reports from representatives on outside bodies
None.

19/21 Correspondence
To discuss any correspondence received for open discussion

  • Notification had been received that BT were proposing to decommission the phone box nest to the toilets. An objection to be raised as this box is used for the emergency calls to enable the defib to be used. Mobile network service is poor in this area.
  • A quotation had been received for the grass cutting contract.

20/21 Councillor Matters
Cllr Shaftesley thanked Cllr Brown for taking on the role of Chair.
Cllr Porter reported that a kerb stone had come loose close to forge Bridge/Forge Farm and was causing damage to tyres and wheels. The Clerk to report to Highways.

21/21 Date of Next Meeting
